Welcome to Duval 4 Life. These Terms of Use ("Terms") apply to duval4life.com, including the 904 Calendar, Outdoor Report and online store, and to content and interactions on social media accounts operated by Duval 4 Life LLC ("Duval 4 Life," "we," "us," or "our"). A third-party social media platform's own terms also apply when you use that platform. By using our website or interacting with our accounts, you agree to these Terms. If you do not agree, please do not use those services.

Local information and event listings

The 904 Calendar and our other posts help people discover Jacksonville and First Coast events, businesses, places and activities. Information may come from organizers, public listings and other third parties. Dates, times, locations, prices, accessibility, age restrictions, availability and cancellation policies can change. We do not guarantee that a listing is complete or current. Confirm important details directly with the organizer, venue or ticket seller before making plans or spending money.

Unless we expressly say otherwise, an event or business appearing on our site or social media is not organized, operated, sponsored or endorsed by Duval 4 Life. Event organizers, venues and ticket sellers are responsible for their own events, services, safety practices, tickets, refunds and representations. Any paid placement or material business relationship in an endorsement will be disclosed where required.

Outdoor Report and safety

The Outdoor Report may display weather, marine, tide, radar, alert and other data from government and third-party sources. Observations and forecasts can be delayed, unavailable or different from conditions at your exact location. The report is general information, not a substitute for official alerts, real-time local conditions or professional safety, navigation or emergency advice. Check the National Weather Service, relevant authorities and conditions before boating, swimming, fishing, traveling or taking part in outdoor activities. Follow official instructions during emergencies.

Store purchases and gift cards

Product descriptions, prices and availability appear on the applicable product page and at checkout. We may correct errors and update offerings before an order is accepted, subject to applicable law. Checkout, payment, shipping, returns and gift card details shown for a particular purchase also apply. Please review those details before ordering. If a product-specific or posted store policy conflicts with these general Terms on a purchase issue, the more specific applicable terms control, subject to your rights under law. A gift card's terms and use are as described on its product page and at checkout.

Your use of the site

You may browse the site, share links to its pages and use its features for lawful personal purposes. You agree not to interfere with the site, bypass security controls, impersonate others, submit false or misleading information, upload malicious code, or use the site to harass or violate anyone's rights. You may not systematically extract listings or copy, mirror, republish or commercially exploit our protected content or original website code without permission, except where applicable law allows. Ordinary search-engine indexing and lawful sharing of individual links are permitted.

We may remove submissions, restrict access or take other reasonable steps if we believe use of the site violates these Terms or the law.

Our content, brand and website code

Our original writing, photographs, videos, graphics, designs, software code and creative selection or arrangement of site content are owned by Duval 4 Life LLC or used with permission from their respective owners, and are protected as applicable by copyright and other law. Duval 4 Life names, logos and branding may not be used in a way that suggests our approval or affiliation without permission. The copyright notice on our site identifies our claim to our own protected work; it does not claim ownership of facts, ideas, third-party materials or content that others submitted and still own.

You may quote brief portions or share links as the law permits, with appropriate attribution where relevant. For broader use of our original material or code, request written permission through our Contact page. Include the specific work, how and where you plan to use it, and whether the use is commercial. We can license only material we own or are authorized to license. Nothing in these Terms removes rights you have under applicable law, including fair use.

If you believe our site or a social account we control uses your copyrighted work without permission, report it through our Contact page. Include your name and contact details; a description of the work and your connection to it; the exact URL of the material at issue; why you believe the use is unauthorized; a statement that your report is accurate and that you have a good-faith belief the use is not authorized by the copyright owner, the owner's agent or the law; and your physical or electronic signature. We may ask for more information, remove or disable the material while reviewing it, and contact the person who submitted it.

If material you submitted was removed and you believe that was a mistake, contact us with the former URL, your explanation and any supporting permission. We will review the response and may restore the material when appropriate. We may decline future submissions from someone who repeatedly sends material without the necessary rights.

Material you send us

If you submit event details, photos, videos, comments or other material to us, you keep any rights you own in it. You represent that the information is accurate to the best of your knowledge, that you have the rights and permissions needed to submit it, and that it does not infringe another person's rights or violate the law. Please do not submit private information about someone else without authorization.

You give Duval 4 Life a nonexclusive, worldwide, royalty-free license to store, reproduce, edit for clarity or format, display, publish and share your submitted material as reasonably needed to review your submission, operate the 904 Calendar and our other services, and promote the submitted event or our coverage through our site and social channels. This license ends when we remove the material from our active services, except for copies reasonably needed for records, legal compliance or posts already shared. We may decline, edit or remove material at our discretion and do not promise to publish any submission.

Submitting an event does not give us ownership of your photographs, videos or other original work. Likewise, tagging our account or using a hashtag alone does not grant us unlimited rights to use your post, image, voice or likeness. Where appropriate, we will seek separate permission or a release for uses of identifiable people or third-party creative work.

Social media interactions

We welcome respectful conversation. Comments and other posts by users reflect their authors' views, not ours. We may hide or remove spam, threats, harassment, unlawful material or content that disrupts our community. Platform rules also govern comments, sharing and removal on each platform. If you believe our content uses your work or likeness without permission, contact us with the specific post and an explanation so we can review it.

You may link to our posts or use a platform's built-in sharing features under its rules. Please request permission before downloading and reposting our original photos, videos or graphics as your own upload or using them for advertising or merchandise. Some material we share belongs to others and may also require permission from its owner. Giving credit, tagging an account or posting something publicly does not, by itself, grant us or anyone else unrestricted rights to copy and republish it.

For identifiable people featured in our interviews or promotional content, we seek permission for the intended use. For a minor, we seek permission from a parent or legal guardian. Permission from a participant does not replace permission needed from a photographer, copyright owner, venue or event organizer. A signed release covers the people who sign or are properly represented; it does not cover everyone present at a location. If you have a concern about an image, video or post, send us the link through our Contact page so we can review it. Copies already shared by others or stored by a platform may remain outside our control.

Links and third-party services

Our site or posts may link to event organizers, ticket sellers, shops, maps, payment processors, social platforms and other services. They operate under their own terms and privacy practices. We do not control their content, availability, transactions or conduct. A link alone does not mean we endorse a third party.

Privacy

When you use a contact form, make a purchase or interact with embedded services, information may be collected by us or by the service providers involved. Any Privacy Policy we publish explains our practices in more detail. Please contact us with privacy questions. These Terms do not replace a Privacy Policy or a third party's privacy notice.

Disclaimer and limits of liability

To the fullest extent permitted by law, the site, listings, reports and other content are provided as available, without a promise that they will be uninterrupted, error-free or suitable for a particular activity. We are not responsible for decisions based on inaccurate or delayed event or outdoor information, or for the acts and omissions of independent organizers and third-party services.

To the fullest extent permitted by law, Duval 4 Life LLC and its owners and staff are not liable for indirect, incidental, special or consequential damages arising from use of the site or our content. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limits a consumer right that cannot lawfully be waived.

Changes and availability

We may update content, features and these Terms. Revised Terms will be posted here with a new effective date and apply prospectively from that date, except where law requires another approach. Your continued use after the effective date means you accept the updated Terms. We may suspend or discontinue a feature when reasonably necessary.

Governing law and disputes

Florida law governs these Terms, except where another law must apply. Subject to applicable law, disputes relating to these Terms or our services may be brought in the state or federal courts located in or serving Duval County, Florida. Before filing a claim, you are welcome to contact us so we can try to resolve the issue informally. This section does not take away any right to bring a claim in another forum where the law protects that right.
